Terms & Disclosure

MoneySmith is an editorial blueprint platform that delivers personalized financial action plans and an optional AI Wealth Coach. All tools, content, and outputs are provided for general informational and educational purposes only.

Tiered usage summary. Services operate on a tiered model. Basic access (read-only, single-tool, free blueprint) carries standard SaaS disclaimers. Advanced access (AI Wealth Coach, multi-tool orchestration, API integrations, data exports) requires enhanced liability waivers, IP indemnification, and output-verification responsibilities. Users assume liability commensurate with their interaction depth. All outputs are AI-generated and the user is accountable for accuracy, legality, and application context.

1. Not Financial Advice

MoneySmith is not a registered investment adviser (RIA), broker-dealer, tax preparer, attorney, or fiduciary. Nothing on the platform constitutes professional financial, investment, legal, or tax advice. Outputs are general frameworks, not recommendations tailored to your specific circumstances. Use of the platform does not create an advisory or fiduciary relationship. Consult a licensed professional before acting on anything you read here.

2. Illustrative Figures

Any figures, values, projections, or examples presented within the platform are illustrative. They are not derived from live market data or verified performance records and do not represent actual outcomes you should expect.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract in your jurisdiction to purchase or use MoneySmith. By using the service you confirm that you meet these requirements.

4. Subscriptions, Cancellation & Refunds

Paid plans bill on a recurring monthly, quarterly, or annual cadence as selected at checkout. You may cancel your subscription at any time through the Stripe Customer Portal, accessible from your account dashboard or via the link in any billing email. Cancellation stops future renewals and takes effect at the end of the current billing period.

We honor a 7-day money-back guarantee on first-time paid plans and one-time deliverables. Refund requests outside the 7-day window are reviewed case-by-case. Refunds are processed via Stripe and typically appear in 5-10 business days. See the full refund policy for details.

5. Acceptable Use

You agree not to scrape, resell, or redistribute MoneySmith outputs without written permission, abuse the AI Coach with automated or bulk requests, attempt to circumvent rate limits or access controls, or use the service for unlawful purposes.

5b. User-Uploaded Content, Strike Policy & Account Termination

By uploading any content to MoneySmith (including but not limited to profile avatars, promotional images, promotional video, community profile media, signature blocks, custom usernames, taglines, and free-form text fields), you agree to the following terms regarding content, conduct, and our graduated enforcement policy:

Prohibited content

You will not upload, display, or transmit content that is: sexually explicit, pornographic, or nude in nature; hateful, racist, antisemitic, transphobic, homophobic, or otherwise targeting individuals or groups based on protected characteristics; threatening, harassing, or doxxing; depicting violence against specific persons; promoting illegal activity; or using slurs of any kind, regardless of intent, irony, "reclamation," or "promotional" framing.

Strike-graduated enforcement

We recognize that an upload occasionally triggers the moderation filter by accident (a borderline-classified photo of you at the beach, an artistic image that scans flagged, etc). To balance protection against accidental flags with strong protection against intentional abuse, the platform operates the following strike policy:

  1. Strike 1-2: The flagged content is blocked from being published. You receive a warning explaining what was detected and can retry with different content. No account penalty.
  2. Strike 3: 48-hour upload lockout — you can continue to use the platform, but new image, video, and avatar uploads are disabled. Existing content remains live. Lockout auto-expires after 48 hours.
  3. Strike 4 (post-lockout violation):If you trigger a moderation flag of the same category again after the 48-hour lockout expires, your account is permanently banned from the community surface and paid services. This is the inflection point where repeated triggering crosses from "accident" into demonstrated pattern of abuse.
  4. Hard-line content — no strikes: Uploads containing CSAM, explicit incitement to violence, slurs (regardless of intent framing), or doxxing skip the strike system entirely and trigger immediate permanent ban on first detection. The strike system is for the accidental edge case, not for content that no reasonable person would defend.

Permanent ban — what happens

  1. Login access remains, but the dashboard is replaced with a banned-account notice: "Banned from MoneySmith community and paid services for repetitively abusing the terms and conditions."
  2. Profile URL, uploaded content, and community presence are removed within 24h.
  3. Funds for unused subscription periods are forfeit (this is explicitly negotiated as part of these terms — by accepting Section 5b, you accept that prepaid funds are not refundable in a termination event triggered by your violation).
  4. Repeat-offender circumvention: Banned accounts cannot be re-created under the same legal identity, same email domain (excluding common providers like gmail.com — alternate emails of the same person are reviewed case-by-case), or same payment method. Attempts to circumvent the ban via new accounts result in those accounts also being banned.
  5. Account backup for review: When an account is banned, a record of the account state, violation history, and content flagged is retained in a secure internal archive for the purpose of admin review in case of disputed or borderline cases. This archive is not used for marketing, analytics, or any other purpose. Banned customers may submit a single review request to support@moneysmith.one; legitimate edge cases (mistaken-identity bans, false-positive moderation flags on demonstrably appropriate content) will be reviewed in good faith. Most ban decisions are final.

"Accidental" / intent framing — not a defense for hard-line content

For the hard-line content category (slurs, CSAM, explicit incitement, doxxing), claiming the content was uploaded as a "joke," "promotional concept," "ironic statement," "reclamation," or any other justification does not exempt the account from immediate permanent ban. The standard is the content displayed, not the intent claimed. The strike system is for genuinely borderline content — not for content no reasonable person would defend in court.

Sole-discretion authority

MoneySmith reserves the right to apply strikes or terminate accounts for content not explicitly covered above when, in our sole judgment, the content damages or risks damaging the platform, other users, or the brand. We will document the reason; we will not engage in extended dispute. By accepting these terms, you acknowledge that content moderation operates at MoneySmith's sole discretion, that automated screening tools (NSFW detection, text-content classification) are applied to all uploads, and that the protections in this clause apply to all users equally regardless of subscription tier (Spark, Compass, Atlas).

6. Intellectual Property

All content, design elements, and system components within MoneySmith are proprietary and protected by applicable intellectual property laws. Your personalized blueprint is licensed for your individual use; unauthorized reproduction, redistribution, or commercial use is prohibited without prior written consent.

7. AI Outputs & User Verification Duty

The AI Wealth Coach (Compass and Atlas tiers) is powered by Anthropic's Claude language models. Outputs are generated probabilistically and may contain errors, omissions, fabricated citations, or outdated information. By using any AI feature, you acknowledge that AI output is not a final answer — you must independently verify any specific number, citation, regulation, tax rule, or claim before acting on it. You assume sole responsibility for downstream decisions based on AI output.

8. Tiered Liability by Usage Depth

Liability allocation scales with the depth of your interaction with the platform:

Selection of a higher tier constitutes affirmative acceptance of these enhanced responsibilities. If you do not accept them, you may use Basic tier only.

9. Limitation of Liability

To the maximum extent permitted by law, MoneySmith and its operators are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost opportunities, or financial losses arising from decisions you made in reliance on outputs from the service — even if advised of the possibility of such damages. Aggregate liability for any claim is capped at the greater of (a) the amounts you paid to MoneySmith in the twelve months preceding the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not permit certain limitations; in such jurisdictions liability is limited to the smallest amount permitted by law.

10. No Warranty

The service is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. MoneySmith does not warrant that the service will be free from errors, bugs, security vulnerabilities, or that AI outputs will be accurate or fit for any specific decision.

11. Indemnification

You agree to defend, indemnify, and hold harmless MoneySmith, Aeocraft LLC, and their operators, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from: (a) your use or misuse of the service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any decision you made or action you took based on platform output.

12. Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of the service will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association, seated in Delaware, except that either party may seek injunctive relief in court for intellectual-property infringement or unauthorized access. You waive any right to participate in class actions, class arbitrations, or representative proceedings against MoneySmith.

13. Governing Law

These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer-protection law requires otherwise.

14. Changes to These Terms

These terms may be updated periodically. The "last updated" date below reflects the most recent revision. Continued use of the platform after a change constitutes acknowledgment and acceptance of the updated terms.
